I have bought several of David Robinson's books on matters legal and lawful.
Legal and lawful though implying the same thing are not synonymous. The
legal beagles of this word speak a language which to all intents and purposes
sound the same. However they are nothing of the sort.
Once you understand the meanings for the usual everyday words used in court
you suddenly find you are so far off the beaten track it could result in possible
prison time for not knowing what those common words mean. You could and
more than likely lose your liberty.
Let me give you an example with the following scenario: You are attending court
for the first or the hundredth time. The charges are read out to you after asking
you for your name. Then the very next thing they ask if you understand the charges.
There are three things in the scenario which are the name, charges and understand.
They seem very reasonable questions , so where is the problem with that?
I am not going to bore you with the three words in question which are YOUR NAME,
The CHARGES and do you UNDERSTAND the charges.
For brevity I will concentrate the simplest of the three words ie UNDERSTAND. You
will probably think what is wrong with UNDERSTANDING the THE QUESTIONS? NOW
I AM GOING TO SHOW YOU THE DIFFERENCE:
The clerk has read the document to you and finally asks you if you understand, you
automatically say yes I do. That is only natural in English but the courts you are NOT
TOLD that it is not English they are speaking. They are using a language which
sounds like English, reads like English but the meanings of the words are very very
different. They are using a language called LEGALESE.
Basic English for UNDERSTAND means you are familiar with the words being used,
and you do understand its use.
In LEGALESE the same word UNDERSTAND means something completely different.
You may think how so. In LEGALESE that word is changed by something called
"WORD MAGIC". It actually means to STAND UNDER what was read to you. This
switch in meaning is completely different to what you believed and comprehended
to mean eg: I comprehend, but you don't. By affirming that you do the courts have
sprung a trap and you have removed all liability to yourself.
As I said English and Legalese are different languages.
The very second you said you understand has changed your position in the courts
eyes. They have maneuvered you into a trap. The trap is sprung and you cannot
release yourself from it. Legalese changes the very meaning of understand into
two English words meaning "STANDING UNDER" the charges meaning you are willing
to pay for your appearance in the court. You have possibly convicted yourself by your
own tongue.
Now what has that to do with STANDING UNDER ? It is a term taken from engineering.
Primeraily in bridge construction. When a bridge engineer completed the bridge he
said would take 50 carts fully laden with produce and it will remaining standing. To
prove that, the engineer stood underneath the structure while 50 fully laden carts
drove on the bridge. If the bridge did what it was he said to do, it was concerned safe
by the engineer as he had STOOD UNDER the bridge. In other words he and his
reputation was intact. He understood the implications of standing under the bridge
that if it did not work he would have died from the ensuing collapse. They
understood as we understand the cost involved. Life or death and everything in
between.
I hope you get the gist of the article and you will better comprehend the meaning
of UNDERSTAND and learn more from the book.

It also starts off with the UCC code, which is a form of law that applies to whatever country you belong to. When you understand the way the UCC code works you'll understand how anybody can use this process, and the people at the top, have to honor your request when you start to quote the UCC code.
